use.

The rules governing access to our stories, digital comics, lore systems, and secure artifact storefront.

These Terms of Use (“Terms”) form a binding agreement between you and Divinium Archive, Inc. (“Divinium,” “we,” “us,” or “our”). They apply to the divinium.archive website, associated digital reading experiences, mobile or desktop applications, newsletters, community functions, and any Divinium-operated storefront or service that links to these Terms (collectively, the “Services”). By accessing or using the Services, you acknowledge that you have read and agree to these Terms.

01. Eligibility and the archive account

You must be at least thirteen years of age, or the minimum digital-consent age where you live, to use the Services. If you are under the age of majority, your parent or legal guardian must review these Terms and accept them on your behalf. Certain purchases, community features, or age-restricted material may require an older user or additional verification.

You are responsible for keeping account credentials confidential and for all activity performed through your account. Provide accurate information, keep it current, and notify us promptly at legal@divinium.archive if you suspect unauthorized access. We may suspend an account that is misleading, compromised, or used in a manner that risks the Services or other users.

02. Digital comics and media access

Divinium grants you a limited, personal, non-exclusive, non-transferable, revocable license to access and view digital comics, books, images, audio, video, and editorial material made available through the Services (“Digital Works”) for your own lawful entertainment and reference. This is a license to access content, not a sale or transfer of ownership.

Digital Works may be streamed, downloaded, or viewed only through the features and device limits we provide. You may not copy, scrape, archive, mirror, sell, rent, sublicense, publicly perform, distribute, retransmit, or create derivative works from a Digital Work except where these Terms, the applicable product description, or mandatory law expressly permits it. Access can vary by territory, edition, subscription status, device, and rights-holder restrictions.

We may update, replace, withdraw, or reformat a Digital Work when reasonably necessary to correct an error, honor a rights-holder request, comply with law, improve accessibility, or maintain the integrity of the archive. We will not use those technical changes to take away a paid access period without providing a legally required remedy.

03. Lore data and community conduct

“Lore Data” includes character preferences, reading progress, saved issues, collection notes, searches, ratings, and other structured information generated by your interaction with the archive. You retain rights in original text or material you submit. You grant Divinium a worldwide, non-exclusive, royalty-free license to host, reproduce, format, and display that submission as necessary to operate the Services, provide support, and improve archive features. We do not claim ownership of your independent creative work.

Do not impersonate an artist or rights-holder, submit unlawful or infringing material, reveal another person’s private information, reverse engineer the Services, bypass access controls, introduce malicious code, automate excessive requests, or use Lore Data to train a competing commercial database without written permission. We may remove material and preserve records when necessary to enforce these rules or protect users.

04. Secure artifact storefront

The storefront may offer books, prints, apparel, replicas, collectibles, and other physical or digital artifacts (“Merchandise”). Product descriptions, availability, taxes, delivery windows, and pricing are displayed at checkout and may change before an order is accepted. A confirmation email acknowledges receipt of an order; acceptance occurs when we dispatch the Merchandise or expressly confirm acceptance.

Use a payment method you are authorized to use. Our payment processors handle payment credentials under their own security and privacy terms; Divinium does not receive or store full payment-card numbers. Do not purchase restricted Merchandise for unlawful export, resale, weapons modification, or any use prohibited by applicable sanctions, customs, consumer-safety, or product laws. We may conduct fraud, age, address, and sanctions screening before fulfillment.

Returns, cancellations, damaged deliveries, and statutory withdrawal rights are governed by the storefront policy shown at purchase. Nothing here limits non-waivable consumer guarantees. Contact support@divinium.archive with the order number and a description of the issue.

05. Intellectual property and reporting

The Services, Digital Works, trademarks, logos, interface, selection and arrangement of the archive, and all related software are owned by Divinium or its licensors and are protected by copyright, trademark, publicity, and other laws. Except for the limited license above, no rights are granted. “Divinium Archive” and associated marks may not be used in a way that suggests endorsement without our written permission.

If you believe material on the Services infringes your copyright, follow the notice process in our Copyright and Content License. Repeated infringement may result in account termination.

06. Disclaimers, limits, and disputes

The Services are provided on an “as available” basis. To the fullest extent allowed by law, Divinium disclaims implied warranties of merchantability, fitness, title, non-infringement, and uninterrupted or error-free access. Lore, editorial commentary, and fictional material are for entertainment and do not constitute professional, medical, financial, legal, or safety advice.

To the fullest extent permitted by law, Divinium and its affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, profits, goodwill, or access. Our aggregate liability for claims arising from the Services will not exceed the greater of the amount you paid to Divinium for the affected Service in the twelve months before the claim or one hundred U.S. dollars. These limits do not apply where prohibited by law.

These Terms are governed by the laws of the State of New York, without regard to conflict-of-law rules. Before filing a claim, you agree to contact us and give us thirty days to investigate. Where permitted by law, disputes will be resolved individually in the state or federal courts located in New York County, New York. You may have rights that override this choice of law or forum.

07. Changes and contact

We may revise these Terms when our Services, legal obligations, or practices change. We will post the revised version and update the effective date. Continued use after the revised Terms take effect means you accept them. If a provision is unenforceable, the remaining provisions remain in effect.
